Today I'd like to talk to you about labor law posters. As you may know, employers are required to post a variety of informational notices telling their employees what their rights are under state and federal employment laws. The notices are usually available by download or by mail from the various government agencies that require specific notices to be posted.
BUT… you have to know what laws you're required to post, and then go find them all.
Once you do get them and hang them up in the office, you wind up with a wall or bulletin board full of documents that may get ripped or look messy.

Do I Need New Labor Law Posters Every Year?
No, you don't need to replace posters every year. You only need to replace your labor law posters when there is a major change in the text of federal or state notices you're required to display change.

The Federal Minimum Wage will be increasing again in 2009, do I need to get a new federal minimum wage poster for 2009?
The federal minimum wage poster that was released in 2007 included the minimum wage rates for 2007, 2008 and 2009. So, if you have that poster, you do not need a new federal minimum wage poster for 2009.
Another thing that businesses often ask is if they still need to post the federal posters if their state minimum wage is higher than the federal minimum wage
And the answer is Yes, you do need to post the federal minimum wage poster, too. That's because the Federal Minimum Wage poster also includes regulations on child labor and overtime rules.
Another question we hear frequently is
Do I need to post labor laws in other languages?
If your entire workforce is fluent in English, you are not required to post federal labor laws in other languages, however you should check with your own state department of labor regarding state regulations.
If your workforce is comprised of a "significant portion of workers who are not literate in English," there are two postings required by federal law to be displayed in "a language in which the employees are literate."
These are the Family and Medical Leave Act (FMLA) Poster, for companies employing 50 or more people, and the Migrant and Seasonal Agricultural Worker Protection Act (MSPA.) for companies employing migrant and seasonal workers.
We also get calls now and then from small business telling us they've gotten mailing that says Final Notice then goes on to tell them there are new regulations out and and if they don't comply by buying a poster, they'll be hit with a big fines.
Be aware that those compliance "notices" are usually ads sent out by commercial companies that try to trick businesses into buying their posters – posters they may or may not need. To find out if you really need new posters check the Department of Labor website, or

How do you know when I do need to update my posters?
You can find information on current requirements by visiting the US Department of Labor's website and your own state's Department of Labor website.

Do I have to buy labor law posters?
No, you don't have to buy them. You can go to various state and federal websites and download the posters you're required to display, print them up on your printer and hang them. The problem with doing that is that hanging multiple printouts may look messy, and you might not find all the laws you’re supposed to post.
The reason most companies do buy labor law posters is that the purchased posters simplify compliance and look more attractive.
